Cycling Accident Injury Claims

Have you been in a Road Traffic Accident as a Cyclist?

Do you cycle to work, school or college? Maybe you cycle for pleasure or even sport? If you do then you will be more than aware of the dangers and lack of co-operation that sometimes ensues between drivers and cyclists on our roads everyday. Unfortunately accidents do happen and it is always best to be prepared. According to The Road Safety Authority (RSA) for the period between 1997 and 2010 well over 600 cyclists have been killed or seriously injured in a road traffic accident in Ireland.

Cycling accidents occur in a number of ways and you could find yourself in the wrong place at the wrong time. Maybe a motorist is failing to adhere to the rules of the road, having difficulty assessing your cycling speed or pulling out of a side road and just not paying attention. The roads we use are fraught with challenges and the consequences of these accidents can be dire and very serious indeed.

How to know if you are eligible to claim compensation for your cycling accident

Before you start an injury claim for your cycling accident, it’s important to note, you may only be entitled to claim if the accident happened in the last 2 years, you can prove that someone else was at fault or partly at fault and if the person owed you a duty of care. As injury solicitors, we are all too familiar with cycling injuries and are well equipped to deal with motorists attempts to avoid responsibility and admittance of liability for the crash.

Cyclists have to manage the roadways with other vehicles, and even the most experienced and careful rider is still too reliant on other road users’ awareness to remain safe. There are many danger zones where cyclists can get injured, but the most common causes include:

  • Drivers turning into the path of a cyclist, reversing out or pulling out in front of a cyclist
  • Drivers failing to see cyclists
  • Falling due to Rugged footpaths, Potholes and other Cracked road surfaces
  • Car doors opening in front of oncoming cyclists
  • Careless, reckless and speeding drivers

FAQs Cycling Accident Claims
  • What can I claim for as a victim of a cycling accident?

Claiming for a bicycle accident will enable you to recover compensation for your injuries and replace or repair your bicycle, amongst other things. There are two types of damages that determine the final figure for your compensation award: general damages and special damages. Special damages deal with all financial losses as a result of your accident. The value of general damages can vary greatly depending on the severity of your injuries. Every cycling accident is different. Where possible, keep a record of receipts and purchases that you have had to make as a direct result of your accident, which will assist in ensuring these costs are recovered.

  • What Special Damages can I claim compensation for a cycling accident?

Special damages deal with all financial losses as a result of your cycling accident. Special damages are different for every claim, and you may find there are more costs for which you can claim. Make sure to retain receipts for any purchases that you have had to make as a direct result of your accident. This will assist in ensuring these costs are recovered. For a cyclist, Special damages can include:

    • Damage to your bicycle & kit– if your bike has been damaged or destroyed your solicitor will include a claim for the cost of repair or replacement of your bike.
    • Loss of earnings If you have to take time off work as a result of the accident and you have suffered a financial shortfall as a consequence, you will be able to recover your financial losses.
    • Medical Costs & Reports– your cycling claim can include provisions for any physiotherapy, surgical procedures and medicines you have paid for or will need to pay for as a result of your accident.
    • Travel costs– if you have to use an alternative form of transport car hire or public transport because your bike was damaged or a write-off, these out-of-pocket expenses can be claimed back.
    • Care and assistance– after your accident, you may have had to rely on carers to help with household chores, or to assist with personal care. We can include as part of your claim.
