Weight Loss Surgery Claims | We Can Help You

Bariatric Surgery (Gastric Band Surgery) Injury Claims

Weight loss surgery is a major event that has the potential to change your life. Unfortunately, things can go wrong and if your operation has not been a success, you might be entitled to put forward a Gastric Band Surgery injury claim to get the support you need – if so, we Synnott Lawline Solicitors can help.

If something has gone wrong during or after your weight loss surgery, we can provide you with legal advice on any potential weight loss surgery claim. Unfortunately each type of weight loss surgery carries a high risk of complications. Some of the complications are recognised and cannot always be avoided, but other errors would be considered negligent and can result in a claim being awarded.

Types of Weight Loss Surgery

  • Gastric band
  • Gastric balloon
  • Gastric bypass
  • Sleeve gastrectomy

Gastric Band verses Gastric Bypass Surgery

Gastric band procedures are a popular form of weight loss surgery undergone by thousands of individuals each year. During the procedure, an adjustable band is used to reduce the size of the stomach so that it is unable to hold large amounts of food.  The procedure is performed with the help of a tiny camera; small incisions are made and the band is put on the upper stomach area to create a pouch which accepts food intake. Because digestion is slowed down, this causes the patient to feel fuller for longer.

Gastric bypass surgery is slightly different and is often a procedure suited to patients who are morbidly obese. Staples are put into the stomach to form a pouch and the intestine is bypassed and moved to form an attachment with the newly made pouch. Both kinds of surgery carry risks and there are a number of ways in which you can experience a surgical error.

Common Issues arising from Negligent Weight Loss Surgery

  • Incorrect placement of gastric band
  • Failure to staple the joins properly during gastric bypass surgery causing a leak
  • Incorrect bypass procedure performed
  • Delay in diagnosing post operative infection
  • Failure to recognise and treat promptly punctures to the stomach causes by the surgery.
